The Dusseldorf Regional Court today gave the final verdict with respect to sales ban on Galaxy Tab 10.1N filed by Apple. The court concluded that unlike the original Galaxy Tab 10.1, the Galaxy Tab 10.1N differs in looks from the Apple iPad and is allowed to sell in the German market.

The Galaxy Tab 10.1N now sufficiently differs from the form Apple has registered as a design right. You can no longer talk of a quasi-identical copy.

The court’s verdict is pretty much the same as the preliminary assessment they did in December.

Samsung may steer clear of the latest allegations put forth by Apple in Germany. Apple’s latest complaint claimed that the revamped Galaxy Tab 10.1 for Germany aka Galaxy Tab 10.1N looked similar to the iPad but the German court sided with Samsung in a preliminary assessment.

Judge Johanna Brueckner-Hofmann said “according to the court’s assessment, the defendant has moved away sufficiently from the legally protected design.”

The final ruling is expected on February 9.

UPDATE 2: Looks like Samsung is ready for the launch as they’ve listed both Wi-Fi-only and 3G variants of Galaxy Tab 10.1N on their website. The prices mentioned here are already being cut down by retailers like Cyberport. But anyways, here it goes:

Wi-Fi-only: 16GB – EUR539; 32GB – EUR619; 64GB – EUR699
3G + Wi-Fi: 16GB – EUR 629; 32GB – EUR749; 64GB – EUR799

UPDATE: Another change in the device is the location of the speakers. Samsung expects to start selling the Galaxy Tab 10.1N by next week. Via

Samsung has been banned to sell the original Galaxy Tab 10.1 in Germany. However, a new variant of Galaxy Tab 10.1 (GT-P7501) has surfaced on German retailer sites that features a slightly revamped design. Although it is unclear what other improvements have been made, the bezel on the Galaxy Tab 10.1N (top) is quite evident as compared to Galaxy Tab 10.1. Also, the tablet now comes pre-loaded with Android 3.2.

Other things we’ve been able to unearth are that it will mostly be restricted to Germany and will come in capacities of 16GB, 32GB and 64GB. Wi-Fi-only (GT-P7511) will also sell with same storage capacities.

The 3G + Wi-Fi tablet pricing starts from 549 euros whereas the Wi-Fi-only will cost around 500 euros.

In a surprising move, Galaxy Tab 7.7 that was unveiled a couple of days back at IFA, has been removed by Samsung from the show. Every demo unit as well as marketing material related to Galaxy Tab 7.7 has been removed by Samsung due to the ongoing litigation with Apple. According to the released statement, Samsung is doing it due to the Dussledorf court’s decision made on September 2.

Samsung respects the court’s decision (The District Court in Dusseldorf) made on September 2 and therefore decided not to display any more the GALAXY Tab 7.7 in IFA. However, we believe it severely limits consumer choice in Germany. Samsung will pursue all available measures, including legal options, to defend its intellectual property rights and ensure its innovative products remain available to German consumers.

At the Dusseldorf court in Germany, the judge has withheld the previous injunction decision against Galaxy Tab 10.1. The judge maintained the decision after hearing arguments of both the parties, restricting the injunction to German boundaries only. However, the court did acknowledge that this decision is not final and certainly not an indication of what will be ruled on September 9.

As Foss Patent points out, the injunction was granted on Apple’s sense of urgency but if Samsung manages to prove that Apple knew the pictures of Galaxy Tab 10.1 since June (as they argued today in court), the injunction decision can be overturned.
