<p>Samsung will soon release Galaxy Y Pro in Netherlands. However, it seems the Dutch subsidiary won’t follow the new nomenclature Samsung has adopted and will sell as Galaxy Txt. Apart from the name change, there won’t be any changes and will have 2.6-inch QVGA (320×240) LCD, 3MP camera, Bluetooth 3.0, GPS, a full QWERTY keyboard, Wi-Fi with Wi-Fi Direct support, microSD card slot and 1200mAh battery.</p>

<p>Not the best of days if you’re a part of Samsung’s legal counsel. The court in Hague has <a href="http://www.reuters.com/article/2011/10/14/us-apple-samsung-idUSTRE79D2UT20111014" target="_blank">rejected</a> Samsung’s claim of patent infringement by Apple and thus, rejecting the appeal to ban on sales of Apple iPhone and iPad.</p>
<p>Judge was of the opinion that Samsung’s 3G patents were a part of essential standards and both companies should negotiate licensing under FRAND. </p>
<p>Meanwhile in United States, U.S. District Judge Lucy Koh <a href="http://www.reuters.com/article/2011/10/14/us-apple-samsung-lawsuit-idUSTRE79C79C20111014" target="_blank">said</a> that Galaxy Tab infringed iPad related patents but the injunction will depend on Apple to prove the patents are valid. </p>

<p>Samsung yesterday <a href="http://sammyhub.com/2011/10/12/samsung-to-sell-modified-galaxy-handsets-to-avert-dutch-ban/" target="_blank">announced</a> to sell modified Galaxy handsets in Netherlands but was mum on the amount of modification. However, they’ve now confirmed to us that the new handsets viz. Galaxy S, Galaxy S II and Galaxy Ace will go on sale from Oct 14 i.e. tomorrow and have a new UI function for ‘photo flicking.’</p>
<blockquote><p>We have applied one of several alternative features that we had developed in order to provide a seamless user experience for consumers.</p>
<p>Models featuring the new UI function (as an alternative to the &#8216;photo flicking&#8217;) will be available on the market from Oct 14th, 2011.</p>
<p>With the &#8216;photo flicking&#8217; feature, the image on screen appears to bounce when the user first touches the display and then flicks to the next image when touched again.</p>
<p>As an alternative, Samsung applied its &#8220;blue glow&#8221; user interface feature, where blue light highlights the edge of the image when the display is first touched. </p></blockquote>

<p>Samsung has announced that they’ll start selling modified Galaxy handsets after they were ordered to stop selling infringed products like Galaxy S, Galaxy S II and Galaxy Ace in Netherlands.</p>
<p>The amount of modification or other details on the handsets are unknown but Samsung spokesperson has confirmed they’ve created these “smartphones using alternative technology.”</p>
<p>These smartphones will only be sold in the Netherlands market as the parent company can still sell the said phones in rest of Europe.	  		</p>

<p>It was a busy day for lawyers representing Samsung and Apple as a hearing for patent infringements was held in two different countries. In Australia, Apple has reportedly reduced the number of patent infringements after Samsung submitted a prototype of the Australia-specific Galaxy Tab 10.1. Apple claims the new Galaxy Tab 10.1 still infringes four patents. While the hearing in Australia is scheduled for tomorrow, <em>Bloomberg</em> <a href="http://www.businessweek.com/news/2011-09-26/samsung-tablet-faces-further-delay-in-australia-amid-apple-row.html" target="_blank">reports</a> that Galaxy Tab 10.1’s launch in Australia could be further delayed.</p>
<p>Interestingly, Samsung’s Australia-centric tablet features were <a href="http://www.itnews.com.au/News/274752,apple-reduces-samsung-tablet-patent-claims.aspx" target="_blank">detailed</a> in the court. Ten features were modified to suit the Australian market, including removal of seven interface features and one hardware and software change.</p>
<p>Meanwhile, in Netherlands, Samsung has <a href="http://news.businessweek.com/article.asp?documentKey=1377-aW5E_u8zhLXU-2IG571M2AI3ER12SQ0044RMM2E" target="_blank">sued Apple</a> for infringing 3G-related patents. According to Samsung, “Apple is consciously, structurally infringing the 3G patents.” Samsung says Apple products like iPhone and iPad use the said 3G related patent and seeks a ban on the products in Netherlands. </p>

The injunction was granted on the patent EP2058868 for a method of scrolling in the Gallery but <a href="http://tweakers.net/nieuws/76361/samsung-blijft-galaxy-s-ii-in-nederland-verkopen.html" target="_blank">according to Samsung&#8217;s lawyer</a>, they&#8217;ll remove the app so the devices don&#8217;t infringe anymore.</p>
<p>Interestingly, Samsung just <a href="http://www.samsungtomorrow.com/1560" target="_blank">posted an article</a> on their official blog saying 10 patent infringements were claimed by Apple and only one was found valid. Galaxy Tab 10.1 is safe as it didn&#8217;t violate any of the claimed patents.   </p>

<p>It seems Apple has again altered an image of a Samsung device to suit their claims in the court. Dutch site, <em><a href="http://webwereld.nl/nieuws/107652/ook-onjuist-bewijs-van-apple-in-nederlandse-zaak.html" target="_blank">Webwereld</a></em> went through the complaint filed by Apple in the Dutch court and found Galaxy S height matching Apple&#8217;s iPhone 3G. In retrospect, Galaxy S measures 122.4 x 64.2mm, which is wider and taller than iPhone 3G&#8217;s 115.5 x 62.1 mm dimensions. </p>
<p>Apple has declined to comment on this issue but this is the second time Apple&#8217;s evidence have come under scrutiny due to the manipulation of filed evidences. Earlier this week, Apple was <a href="http://sammyhub.com/2011/08/15/apple-manipulated-pictorial-evidence-to-gain-an-injunction-against-galaxy-tab-10-1/" target="_blank">found tampering</a> with the image of Galaxy Tab 10.1 making it smaller and wider to match the iPad 2.</p>
<p>The Dutch court will <a href="http://sammyhub.com/2011/08/11/dutch-court-hears-apples-arguments-against-samsung-will-give-a-decision-on-september-15/" target="_blank">announce</a> their decision on September 15.</p>

<p>Samsung has confirmed to launch its Galaxy Tab 10.1 device in Netherlands. Samsung&#8217;s larger-sized tablet will go on sale from August 23 and will be available in various stores for 599 euros. Although the ongoing legal battle with Apple puts the tablet&#8217;s future in danger, Samsung spokesperson did confirm that the tablet will be on sale till October 23 if an injunction is granted against the tablet. If not, it will continue to sell as before.</p>

<p>Unlike the <a href="http://sammyhub.com/2011/08/09/apple-wins-an-injunction-to-stop-galaxy-tab-10-1-sales-in-eu-except-netherlands/" target="_blank">German proceedings</a>, the Netherlands court today held a hearing on the Apple-Samsung case and after hearing all the arguments and defense, the court has decided to defer their decision till September 15. Apple argued in the court that Samsung&#8217;s Galaxy Tab 10.1 was identical to their iPad and even backed with an online market research that favored the iPad maker. However, Samsung shot back saying Apple claims are generalized and according to &#8220;Apple&#8217;s standards every digital photo frame is an iPad&#8221; and even asked the court to dismiss the case as it was &#8220;too elaborate and complex for summary proceedings.&#8221; </p>
<p>The judge has now more than a month to analyze if Samsung infringed on the said patents or not and if the ruling is against Samsung, the injunction against the tablet couldn&#8217;t be enforced sooner than October 13. </p>

<p>Hot on the heels of the <a href="http://sammyhub.com/2011/08/09/apple-wins-an-injunction-to-stop-galaxy-tab-10-1-sales-in-eu-except-netherlands/" target="_blank">European injunction</a>, news comes that Samsung will sue Apple in the Dutch court. Netherlands is the only country where the injunction does not apply. According to <a href="http://webwereld.nl/nieuws/107550/samsung-sleept-apple-voor-nederlandse-rechter.html" target="_blank"><em>Webwereld</em></a> the proceedings for Samsung&#8217;s case will start from August 17.</p>
<p>Meanwhile, the site also <a href="http://webwereld.nl/nieuws/107552/apple-eist-verbod-op-samsung-galaxy-s-in-nederland.html" target="_blank">reports</a> that Apple is seeking a ban on Samsung products. Apple will apparently file an injunction motion for Galaxy Tab tomorrow and Galaxy S the day after. </p>
