Australia grants temporary injunction against Galaxy Tab 10.1 [Updated]

The verdict of the initial Australian hearing of Apple-Samsung patent case is out and it does not look good for the Korean manufacturer. The Australian Federal Court has granted a temporary injunction against the launch and sale of Galaxy Tab 10.1 in Australia. The ban will make Samsung to miss the important Christmas season.

Judge Annabelle Bennett ruled that Samsung’s tablet infringed two of Apple’s patents and has given Samsung an option to expedite the final hearing; however, Samsung has declined as they need time to “prepare a proper defense against Apple’s case.”

Meanwhile, Samsung has confirmed to fight back and will “seek legal advice” to proceed further.

This is the second region after Germany where the Galaxy Tab 10.1 has been banned and could prove instrumental as hearings in courts of South Korea and United States are just around the corner.

We are disappointed with this ruling and Samsung will take all necessary measures including legal action in order to ensure our innovative products are available to consumers.

This is a part of our ongoing legal proceeding against Apple’s claim. Samsung is also confident it can prove Apple’s violation of Samsung’s wireless technology patents through a cross claim filed on September 16, 2011 with the Federal Court of Australia, New South Wales.

Our wireless standard patents are essential for mobile business. We will continue to legally assert our intellectual property rights against those who violate Samsung’s patents and free ride on our technology.
