UPDATE: Samsung says they’re confident of coming clean in the EU investigation. Via

Samsung has an ongoing tussle with Apple but they’ll now have to deal with the European Commission as well as they’ve opened a formal investigation against them. The EU Commission will assess whether Samsung has abused its position and breached EU antitrust rules with respect to use of certain patents which are declared essential to implement European mobile telephony standards.

Furthermore, the commission will also investigate Samsung’s commitment to license any standard essential patents to other companies on fair, reasonable and non-discriminatory (FRAND) terms.

The EU Commission said that patent holders, including Samsung gave an irrevocable commitment to European Telecommunications Standards Institute (ETSI) to allow licensing of patents that are considered essential for the implementation European mobile telephony standards.
