U.S. District Court Judge Lucy Koh has denied Apple’s request to speed up the federal trial against Samsung. The Judge reckons there is an inconsistency in Apple’s position and action and though this is some good news for Samsung, this does not have any effect on the preliminary injunction motion filed by Apple.
Judge in the order says “Apple has not established substantial harm or prejudice justifying a shortened briefing and hearing schedule.” Judge in fact wants to give some time to Samsung to develop their case against Apple’s motion.
Another statement that works against the iPhone maker is the fact that Apple was aware of the infringement for at least a year and despite knowing it, didn’t sue Samsung.
“The Court agrees with Samsung that the length of time Apple has been aware of its claims and the long history of infringement alleged in the complaint undermine Apple’s claims of urgency to some extent.”

Google also has to look at non-patent trials like these that affect Android. “Everything” that needs to be fought can not and should not be left at the behest of the manufacturer.
