Galaxy Tab 10.1 does not infringe iPad design rules Dutch Supreme Court

The Supreme Court of the Netherlands today ruled in favour of Samsung saying the Galaxy Tab 10.1 does not infringe on Apple’s iPad design. Apple alleged that Samsung infringed on iPad’s community design that is valid in the EU region but the court concluded that although the design is valid, the protection is limited due to previously marketed products or prior art and dismissed the appeal.

The court also found the design of the Galaxy Tab 10.1 and iPad are different and does not confuse the consumer.

Apple was not the first to design a tablet with a rectangular shape and rounded corners. No company should have a monopoly on general designs.
