The suggested set of commitments which Samsung had offered in October 2013, has now been accepted by the European Commission. In a press release sent by the EU Commission, the Commission formally accepts Samsung’s commitments and legally binds it under EU antitrust rules.
As per the commitment offered by Samsung, the Korean giant will not pursue any injunction against a company for a period of five years in Europe on the basis of its standard essential patents (SEPs) against “licensees who sign up to a specified licensing framework” and any disputes arising out of this framework will be decided by the court or an arbitrator.
For licensees, Samsung’s commitment will act as a “safe harbor” wherein all “potential licensees are protected against any litigation injunctions sought by Samsung on the basis of such SEPs if they submit to the licensing framework provided for by the commitments.”
